Regulations

I. GENERAL PROVISIONS

1. This regulation defines the conditions for booking Apartments at Aparthotel ZATOR. The agreement between the Guest and the Owner of the Apartment is concluded upon making a reservation through the internet: the website, Booking, Airbnb, OLX, or through direct sales: by phone and email. It is the Guest’s responsibility to familiarize themselves with the content of the Regulations before making a reservation.

2. The regulation is openly available 24/7 throughout the year on the website: www.aparthotel-zator.pl in Polish and English. Additionally, the regulation in both Polish and English is provided in each Apartment.

3. It is considered that at the time of booking (via the website, booking portals such as Booking, Airbnb, OLX, advertisements, by phone, email, etc.) and performing implicit actions, especially through making a reservation and/or paying a deposit or the full amount for the stay at Aparthotel ZATOR – the Guest fully accepts this regulation and commits to strictly adhering to the rules in force at Aparthotel ZATOR, assuming all obligations and consequences arising from it.

4. At the time of booking, the full amount of the stay or a deposit amounting to 30% of the full stay amount is charged.

5. The lead time for booking and waiting for payment settlement for the stay is 36 hours.

6. Once the payment is received, the reservation is confirmed.

7. Failure to pay the deposit or the full amount within 36 hours from the date of the initial reservation results in the cancellation of the agreement.

8. In the case of paying a deposit during the initial reservation, the remaining amount for the stay must be paid no later than 7 days before the planned arrival.

9. “Last-minute” reservations and the full amount of the stay must be paid by immediate bank transfer.

10. Cash payments are not accepted.

11. Customer Service and Aparthotel ZATOR’s Service may verify the Guest’s identity to confirm their identity.

12. Claims arising from the lack of prior acquaintance with the Facility Regulations during the stay will not be considered.

13. Information boards in the Apartments are treated as an integral part of the Regulations.

14. Prices for individual Apartments and additional services may vary depending on the season.

15. The Property Owner reserves the right to refuse accommodation and admission to Guests who show verbal or physical aggression towards staff, operators, or other Guests, or are under the influence of alcohol or drugs.

II. TERMS OF THE LEASE AGREEMENT

1. The rental price includes: utility fees (electricity, water, heating), and final cleaning. NOTE: We do not handle Apartment services, such as waste disposal, cleaning during the stay, supplying accessories like toilet paper, trash bags, etc. We do not offer transportation, and we do not fulfill special requests, such as lighting candles, filling the jacuzzi with water before the arrival of Guests, etc. The only possible form of prior preparation of the Apartment is decorating it with flowers/balloons, etc., as part of a previously purchased celebratory package

2. PARKING: Parking is unguarded and available for the Apartment depending on availability: underground or surface. The parking space assigned to the Apartment is marked with a number, and the Guest receives the parking space number in a private message. The Guest agrees to park their vehicle in the designated parking space.

3. RESPONSIBILITY: Aparthotel ZATOR is not responsible for damage or loss of the Guest’s car or other vehicles, items left in it, and live animals, whether the vehicle is parked in Aparthotel ZATOR’s parking space or outside the designated parking space (e.g., on a public road, internal road, sidewalk, etc.).

4. LIABILITY: Aparthotel ZATOR is not responsible (including not participating in costs charged by other parking space owners due to improperly parked cars, police fines for improper parking, etc.).

5. PARKING BLOCKADE: Each surface parking space owned by Aparthotel ZATOR has a parking blockade. In each Apartment, a designated key fob for the blockade is visibly placed, and it must be left in the Apartment after the stay. In case of losing the key fob or not returning it, the Guest will be charged the cost of a new one.

6. RESPONSIBILITY FOR BLOCKADE: Aparthotel ZATOR is not responsible for occupying a parking space if the Guest does not lock the parking blockade each time they leave the parking spot.

7. PARKING INFORMATION: The Guest receives a message with a number indicating the parking space belonging to Aparthotel ZATOR and all necessary check-in details in Polish or, for foreign Guests, in English. Surface parking spaces are located within the respective Apartment building. Each Apartment building may have the same parking space numbers, but special attention should be paid to the Apartment building number and the rented Apartment.

8. APARTMENT RENTAL: Apartments are rented for hotel nights. The hotel night starts at 15:00 on the day of arrival and ends at 10:00 on the day of departure.

9. CHECK-IN INFORMATION: On the day of arrival, the Guest receives all check-in information, parking space number, address, stay details, access codes to the building and Apartment. It is prohibited to share access codes to the building and Apartment with third parties or those not reported in the reservation process. Breaking this rule may result in a fine of PLN 500. In case of non-payment agreement and the amount due, the Owner will seek compensation through legal and judicial means.

10. DELAYED ARRIVAL: If there is no possibility to arrive at the agreed-upon time, the Guest is obligated to inform the reservation contact person by phone.

11. PAYMENT OBLIGATION: The Guest is required to pay the confirmed reservation amount, even if the arrival or stay is delayed or shortened (due to transportation difficulties, personal reasons).

12. REPORTING INCIDENTS: The Guest must immediately report, solely by phone (not via SMS, MMS, messages on social messengers, or email), any events that may cause harm to the owner of the property. The tenant is also responsible for the keys to the waste shed (if any), entrance doors (if any), and the garage or parking blockade remote control (if any), and in case of loss, is obligated to cover the costs.

13. USAGE AND SUBLETTING: The Guest may use the premises solely for short-term rental and recreational purposes and may not sublet the property to others.

14. DAMAGES AND LIABILITY: The Guest is responsible for any damages caused to the property’s equipment and the property itself and agrees to cover them no later than on the day of departure. In case of discovering damage during Apartment inspection by the service, failure to report the damage by the Guest, leaving the Apartment, and in the absence of agreement and amicable payment of the due amount, the Owner will seek compensation through legal and judicial means.

15. REPORTING DAMAGES: The Guest agrees to promptly notify the Property Owner of any damages, including, for example, bathtub malfunctions, flooding of the Apartment, 24/7 at the phone number +48 505 605 215. We do not respond to text messages (SMS), MMS, emails, messengers, or other social media communicators. Reports are considered only and exclusively after a phone call. Other forms of contact will not be considered as damage reports.

16. QUIET HOURS: Silent hours are enforced in the property from 22:00 to 7:00 the next day. The use of water jets in the jacuzzi is prohibited after 22:00.

17. JACUZZI RULES: It is prohibited to throw solid objects into the jacuzzi, such as flowers, roses, rose petals, food items, confetti, artificial flower petals, balloons, etc. The only allowed substance is bath salt provided by Aparthotel ZATOR. Breaking this rule may result in a fine of PLN 500. In case of non-payment agreement and the amount due, the Owner will seek compensation through legal and judicial means.

18. TOILET USAGE: It is prohibited to throw hygiene products, such as tampons, pads, disposable towels, trash, etc., into the toilet.

19. JACUZZI INSTRUCTIONS: The Jacuzzi User Manual is available in each Apartment and is an integral part of the Regulations. Aparthotel ZATOR may charge additional costs for service, bathtub repairs, additional accessories, or the total cost of tub replacement in case of damage caused by improper use or entry of more people into the jacuzzi than the 2 persons reported in the reservation process. In case of non-payment agreement and the amount due, the Owner will seek compensation through legal and judicial means.

20. SITTING ON JACUZZI GLASS PARTS: Sitting on the glass parts of the tub is strictly prohibited. This can lead to leakage or cracking of the tub walls. Aparthotel ZATOR may charge additional costs for tub repair or replacement in case of violating this regulation. In case of non-payment agreement and the amount due, the Owner will seek compensation through legal and judicial means.

21. VAT INVOICE: The Guest agrees to issue a VAT invoice without a signature.

III. CUSTOMER RESPONSIBILITIES

1. The Apartment cannot accommodate more people than reported during the reservation process. Apartments are for 2 persons only, EXCLUSIVELY FOR ADULTS, and the number of persons accommodated may not exceed this number (including children) unless the owners agree to a child’s stay. This matter must be agreed upon before making the initial reservation. If the Guest does not respect this rule, the Owners may refuse entry to the Apartment, and (if the Guest secretly brings in an additional person) the Owner has the right to evict the Guest halfway through the stay without a refund of the entire stay amount.

2. The Guest may not bring in external persons for events or gatherings.

3. The Owner may impose a fine of PLN 500 per person for each additional person secretly brought into the property. The person who made the reservation will be held responsible for paying the fine. In case of non-payment agreement and the amount due, the Owner will seek compensation through legal and judicial means.

4. In case of organizing any kind of events, bachelorette or bachelor parties, gatherings, and others, breaking the regulations will result in an additional fine of PLN 1000 and possible additional costs for damages to the premises and additional cleaning. In case of non-payment agreement and the amount due, the Owner will seek compensation through legal and judicial means.

5. ADDITIONAL COSTS:

  • Additional cleaning: PLN 350,
  • Intervention cost: PLN 400 in case of disturbing the peace of residents and other Guests, disturbing domestic peace, violating the principles of good neighborhood (even during the day caused, among other things, by alcohol, drugs, etc.), and in connection with disturbance primarily during the quiet hours, organizing an illegal “party,” etc.
  • Additional costs may also arise after inspections of the Apartment, such as drying the Apartment after flooding, ozonation, damage to the jacuzzi, damage to duvets, towels, vacuum cleaner, broken glass, damaged equipment, damaged appliances, flooding and drying of neighboring premises, etc.

6. In disputed matters related to Apartment damage, disturbance of domestic peace, quiet hours, refusal to pay a fine, verbal and physical aggression against Employees, etc., the Police will be summoned each time.

7. Additionally, the case will be referred to the Legal Office representing Aparthotel ZATOR, and the payment of the fine and any compensation will be enforced through legal proceedings and court proceedings.

8. The Guest will also be charged an additional amount for legal and court proceedings.

9. It is forbidden to use the Apartments for commercial purposes, e.g., photo sessions, film sessions, etc., without the consent of the Owner. In case of discovering a violation of this point of the regulations (e.g., finding photos on the internet, videos, even after a long time, etc.), a fine of PLN 2000 will be imposed. In case of non-payment agreement and the amount due, the Owner will seek compensation through legal and judicial means. Additionally, the case will be referred to the Legal Office representing Aparthotel ZATOR, and the payment of the fine will be enforced through legal proceedings and court proceedings. The Guest will also be charged an additional amount for legal and court proceedings.

10. The Guest is obligated to observe the principles of good neighborliness and maintain the apartment in its original condition.

11. The behavior of Guests should not disturb the peace of others. Persons under the influence of alcohol or drugs, behaving aggressively, disrupting the peace and/or well-being of neighbors, and not adhering to commonly accepted norms of human coexistence, may be immediately evicted by the Apartment Owner without a refund for the unused period of stay.

12. The Property Owner has the right to refuse accommodation and reception of Guests who exhibit verbal or physical aggression towards employees, operators, or other Guests. The previously paid deposit is not refundable.

13.  Aparthotel ZATOR may refuse to accept a Guest who has blatantly violated the Regulations during a previous stay, especially by causing damage to the property of Aparthotel ZATOR or other Guests, damage to the person of the Guests, Customer Service, Aparthotel ZATOR Service, or other persons staying on the premises.

14. Each time the Apartment is vacated, it must be checked to ensure it is closed. It is strictly prohibited to remove items that are part of the Apartment’s equipment (e.g., towels, bathrobes, blankets, pillows, plates, glasses, cutlery, devices, etc.). The rented Apartment must be taken care of, unnecessary lighting must be turned off, windows closed, air conditioning turned off, and water turned off when not in the Apartment.

15. The Owner is not responsible for renovation work taking place on the premises during the Guests’ stay.

16. Smoking, including the use of electronic cigarettes, is strictly prohibited in the Apartments. Designated smoking areas are provided on balconies. Smoking inside the Apartments is subject to a fine of PLN 500. Additionally, the Guest may be charged an additional amount for ozonation and additional cleaning of the Apartment (including additional washing of curtains, drapes, throws, etc.). In case of non-payment agreement and the amount due, the Owner will seek compensation through legal and judicial means.

17. Cooking fish and popcorn is strictly prohibited in the Apartments, with a fine of PLN 500. The Guest may be charged an additional amount for ozonation and additional cleaning of the Apartment (including additional washing of curtains, drapes, throws, etc.). In case of non-payment agreement and the amount due, the Owner will seek compensation through legal and judicial means.

18. The Guest stays in the Apartment at their own risk and responsibility.

19. Special care must be taken on balconies, and there is also a prohibition on throwing any objects, cigarette butts, or food waste.

20. In case of disturbance of quiet hours by other Guests on the premises, incidents should be reported individually to the appropriate authorities/police.

21. The Guest is obligated to use the Apartment according to its purpose. Guests are not allowed to make any changes to the rooms and their equipment, except for minor furniture rearrangement that does not affect their functionality and safety.

22.The Apartment lessee should use household appliances and other devices according to their intended purpose while observing general safety rules. Instructions for using household appliances and audio-visual equipment, air conditioning, etc., are available in each Apartment. It is forbidden to turn on an empty microwave, put metal objects (e.g., cutlery) inside, heat metal or metal-containing utensils (handles, decorations), wooden utensils and dishes, sushi sticks, plastic packaging, containers, plates, cups, cutlery, bottles, straws, etc., aluminum foil, containers, trays, ready-made lasagna, etc., styrofoam packaging from take-out dishes, etc., paper bags, cups, plates, etc., gilded tableware, etc., tightly closed containers, jars, etc. Additionally, guests are instructed not to pour fatty dishes, not to cook eggs in their shells, not to thaw butter, margarine, etc.

23. It is prohibited to conduct acquisition and door-to-door sales, as well as gambling activities at Aparthotel ZATOR. Additional charges may be imposed for violating this point of the Regulations, with the amount to be determined individually.

IV. CHANGES IN BOOKING

The stay in a specific Apartment can be extended for an additional fee (if the apartment is available). However, notification of the extension must be made exclusively by phone (not SMS) to the person responsible for the reservation no later than 8:00 a.m. on the originally planned departure day. The cost of extending the stay will be determined individually. The extension fee for the apartment is to be paid via immediate bank transfer. We do not accept cash payments.

1. Unjustified retention of the Apartment after 10:00 a.m. may be treated as an extension of the day.

2. In case of reservation cancellation:

    1. At least 14 days before the start of the stay: The deposit will be refunded, or the full amount of the stay will be refunded.
    2. At least 13 days before the start of the stay: The deposit or the full amount of the stay is non-refundable. Changing the stay dates – If the Guest wishes to change the stay dates or shorten the stay, the Guest must inform the person responsible for the reservation at least 14 days before arriving at the Apartment. This rule also applies to Guests who, for personal reasons, cannot arrive on the designated date. A new date will be scheduled based on availability, excluding days when a different rate applies than the amount for which the original reservation was made. The deposit or the full amount of the stay is forfeited if the Guest does not show up at the property.

3. All changes to reservations and changes to the stay dates less than 14 days before the planned arrival will not be considered. The deposit or the full amount of the stay is non-refundable.

4. The Owner has the right to cancel the preliminary reservation within 24 hours of the reservation without giving a reason.

V. TRANSFER OF GUEST’S RIGHTS AND OBLIGATIONS TO ANOTHER PERSON:

1. At any time, the Guest may transfer all rights arising from the reservation to another person, provided that this person takes over all obligations arising from this reservation.

2. In this situation, the Owner should be notified of the change in the person making the reservation.

VI. PETS:

1. Pets are not allowed.

2. The Owner has the right to refuse accommodation without returning the deposit, or if the Guest secretly brings in a pet, the Owner has the right to evict the Guest during the stay, without refunding the entire fee for the stay.

3. Additionally, the Guest of the Apartment bears full material responsibility for any damage or destruction caused by a secretly introduced animal, as well as for leaving animals unattended in the Apartment.

4. Secretly introducing animals into the Apartment is subject to a fine of PLN 500. The amount may increase for damages caused by the animal. In case of non-payment agreement and the amount due, the Owner will seek compensation through legal and judicial means.

VII. DESIGN AND ADDITIONAL SERVICES:

1. We reserve that food products, champagne, and decorative elements such as balloons, glowing signs, fresh flowers, chocolates, etc., shown in promotional photos and videos, are not included in the basic offer. These are additional services subject to payment, included in Special Occasion Packages, after agreement with the Customer Service Department of Aparthotel ZATOR. The only standard addition to the Apartment is bath salts, candles in glass covers, and a welcome kit consisting of 2 bottles of mineral water, 4 tea bags, 4 coffee bags, 1 Oreo cookie, and 4 sugar packets. Guests also have access to board games, books, and, upon special request (with prior notice), a yoga mat.

2. Seasonal decorations may change and differ in individual Apartments and seasons.

3. Decorations shown in photos or promotional videos may not be a permanent part of the Apartment’s furnishings or may not be available to Guests.

4. Due to ongoing renovations (refreshing or repair-related) in the Apartments, the offer presented in the photos may slightly differ from reality in terms of color and design (including the appearance of individual furnishings such as bedspreads, blankets, curtains, plates, cutlery, mugs, decorations, and individual furniture pieces). However, the presented offer should correspond to the type of equipment provided in the Apartment (microwave, TV, coffee maker, electric kettle, stove, etc.) and other equipment items listed in the offer.

VIII. LEFT PERSONAL ITEMS

1. Items left by the Guest after leaving the Apartment can be sent to their specified address at their expense upon request.

2. Otherwise, after 3 (three) days from the Guest’s departure from the Apartment, the Staff will handle the items in accordance with the regulations on lost or found items.

IX. FIRE PROTECTION RULES

1. Due to fire protection requirements in the Apartment, it is not allowed to use any devices or appliances powered by electricity or gas that are not part of the room’s equipment and could pose a fire hazard, e.g., electric heaters, gas burners, toasters, etc.

2. Bringing flammable materials, explosive materials, or materials with an unpleasant odor into the Apartment is prohibited. The use of candles (including tealights) that are not part of the Apartment’s equipment is strictly prohibited, unless accompanied by additional protection in the form of a glass candle holder.

3. Hazardous materials, weapons, ammunition, flammable materials, explosive materials, or illuminating materials cannot be stored in the Apartments. In each Apartment, there is:

  • a functioning smoke detector
  • a fire extinguisher
  • occupational health and safety boards, first aid kits, fire instructions, emergency contact numbers

X. FORCE MAJEURE

1. In the event of unforeseeable circumstances that cannot be immediately eliminated by conventional means, the Owner reserves the right to offer the Guest a substitute facility similar to the originally reserved facility.

2. The Owner has the right to cancel the agreement in the event of force majeure. This also applies to cases where the personal safety of the guest or their property cannot be guaranteed due to reasons beyond the Owner’s control.

3. Amounts paid by the Guest are subject to an immediate refund with the deduction of amounts due for services already provided.

XI. FORCED OPENING OF THE APARTMENT

1. The Owner and Service Staff have an additional entry code for the Apartment door.

2. In the event of sudden malfunctions (e.g., flooding of the Apartment and neighboring premises) or other urgent defects, the Owner or Service Staff may enter the Apartment to carry out repairs in the absence of Guests.

3. The code may also be used if there is suspicion of dangerous situations threatening the health and life of Guests and other persons in the building, as well as the risk of property loss.

4. If the Guest does not vacate the Apartment within the specified period and by 10:00 a.m. on the day of departure, the Owner or Service Staff may use the emergency code to check the Apartment.

5. Forced opening of the Apartment is ALWAYS done in the presence of a Witness.

XII. MONITORING

1. Entry into the Apartment is monitored (intercom with a camera) for security purposes.

2. The camera covers only the external part of the entrance door and part of the corridor.

3. Recordings from the camera are never disseminated, image transmission technology is secure, and the system is password-protected with no access by third parties. Monitoring is transparent.

4. Information boards with basic information are available in the Apartment.

5. We do not covertly record our Guests as it contradicts transparency.

6. In ordinary situations, data is stored for a period of 7 days, then permanently deleted.

7. In case of disputed situations, legal proceedings, recordings are secured and stored for a longer period until the matter is resolved.

8. Recordings are password-protected to prevent data leaks.

XIII. DUTIES AND LIABILITY OF APARTHOTEL ZATOR

1. Aparthotel ZATOR provides services in accordance with its category and standard.

2. Aparthotel ZATOR is not responsible for the loss or damage of items brought in by individuals using the services of Aparthotel ZATOR, including as a result of improperly closed doors, windows, the entry of third parties into the Apartment, etc.

3. Items (including, but not limited to, money, valuable papers, electronic and digital devices, and other valuable items, especially valuables and items of scientific or artistic value) should be placed in the safe in each Apartment.

XIV. PERSONAL DATA PROTECTION

XV. COMPLAINTS

Regardless of and without prejudice to the rights conferred by universally applicable law regarding the submission and pursuit of claims, Guests have the right to file complaints in case of deficiencies in the quality of services provided.

1. The Guest has the right to submit a complaint immediately after noticing deficiencies, allowing Aparthotel ZATOR’s service to improve the standard of services.

2. The complaint should be submitted in writing immediately after the end of the stay to the address for service of the Administrator or electronically to the address: biuro@aparthotel-zator.pl

3. The complaint includes, in particular: the name, surname, address of the Client, reservation number, and the subject of the complaint, as well as circumstances justifying the complaint.

4. If Aparthotel ZATOR does not promptly remedy the Guest’s reported objections (if possible by customary means or in accordance with the Regulations), Aparthotel ZATOR will respond to the complaint within 30 (thirty) working days from the date of the Guest’s complaint and inform them about the further procedure.

5. All refunds for Clients will be processed within 30 working days from the date of sending correct data to the address for service or e-mail: biuro@aparthotel-zator.pl.

XVI. FINAL PROVISIONS

1. The Administrator reserves the right to make changes/modifications to the Regulations at any time without notice, and unless otherwise specified, the changes will take effect immediately upon publication. Therefore, we recommend periodically checking these Regulations and rules for any changes.

2. Matters not regulated herein shall be governed by the relevant provisions of the applicable law.

3. In the event of a dispute between the Administrator and the Guest, it will be resolved by the court with jurisdiction according to the principles outlined in the Code of Civil Procedure.

4. The applicable law shall be Polish law.
